Terms of Service

By accessing or using HireSagar (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms constitute a binding legal agreement between you (individually and on behalf of your organisation) and HireSagar. By creating an account, you confirm that you have the authority to bind your organisation to these Terms.

2. Description of Service

HireSagar is a hiring intelligence and applicant tracking platform. The Service includes resume parsing, candidate evaluation and scoring, interview question generation, pipeline management, and related features. Some of these features are produced by a deterministic analysis engine and some by automated reasoning that uses third-party language-model providers; both are covered by these Terms.

3. Accounts and Organisations

• Each organisation has its own isolated workspace. Data is not shared between organisations.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately of any unauthorised access to your account.
• You must not create accounts to circumvent plan limits or abuse the free trial.

4. Free Trial

New organisations receive a 7-day free trial with limited usage (20 resumes, 350 Intelligence Operations). At the end of the trial, access is restricted until a paid plan is selected. We reserve the right to terminate trial accounts that show signs of abuse (VPN abuse, disposable email addresses, repeated re-registration).

5. Subscription and Billing

• Paid plans are billed monthly or annually in advance.
• Plan limits (resumes, Intelligence Operations, recruiters, jobs) reset at the start of each billing period.
• Unused Intelligence Operations do not roll over to the next billing period.
• Downgrades take effect at the end of the current billing period.
• Upgrades take effect immediately; you will be charged a prorated amount.
• Annual plans are non-refundable after 14 days.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable employment discrimination laws
• Attempt to reverse-engineer, scrape, or extract AI model weights or training data
• Inject adversarial content into resume uploads to manipulate AI outputs
• Exceed plan limits by automated means or create multiple accounts
• Use candidate data for any purpose other than legitimate hiring decisions
• Resell, sublicense, or white-label the Service without an Enterprise agreement

7. Candidate Data and GDPR Compliance

You are the data controller for candidate personal data uploaded to HireSagar. You are responsible for:

• Having a lawful basis for processing candidate personal data
• Informing candidates that their data will be processed by AI systems
• Handling data subject requests (access, erasure, portability) promptly
• Complying with applicable data protection laws in your jurisdiction

HireSagar acts as a data processor on your behalf. We process candidate data only as instructed by your use of the Service.

8. AI-Generated Content Disclaimer

AI outputs (scores, recommendations, interview questions, risk flags) are provided as tools to assist human decision-making. They are not guarantees of candidate quality or suitability. HireSagar makes no warranty that AI outputs are accurate, complete, or free from bias. Hiring decisions remain the sole responsibility of the user.

9. Intellectual Property

HireSagar retains all intellectual property rights in the Service, including the platform, UI, AI models, and documentation. You retain all rights to your candidate data and company data uploaded to the Service.

10. Limitation of Liability

To the maximum extent permitted by law, HireSagar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability to you shall not exceed the amounts you paid to us in the 12 months preceding the claim.

11. Termination

Either party may terminate at any time. Upon termination: your access is revoked immediately; your data is retained for 30 days (so you can export it), then deleted. We may suspend or terminate accounts that violate these Terms without notice.

12. Changes to Terms

We will provide 14 days’ notice of material changes via email or in-app notification. Continued use after that date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which HireSagar is incorporated. Disputes shall be resolved by binding arbitration in that jurisdiction.
